Ky term reflekton vazhdim\u00ebsin\u00eb historike dhe etnokulturore t\u00eb shqiptar\u00ebve n\u00eb k\u00ebt\u00eb hap\u00ebsir\u00eb. Etnocidi kulturor \u2013 shkat\u00ebrrimi i elementeve kulturore, memorialeve, simboleve dhe hap\u00ebsirave publike q\u00eb mbajn\u00eb identitetin kolektiv t\u00eb nj\u00eb komuniteti etnik. Shprehja simbolike \u2013 \u00e7do form\u00eb e shprehjes kulturore, p\u00ebrfshir\u00eb memorialet, lapidar\u00ebt, toponimet, dhe objektet e kujtes\u00ebs kolektive, q\u00eb p\u00ebrb\u00ebjn\u00eb pjes\u00eb t\u00eb t\u00eb drejt\u00ebs p\u00ebr shprehje dhe identitet. Autoktonia dhe t\u00eb drejtat kolektive<\/div>\n<div dir=\"auto\">Koncepti i autoktonis\u00eb p\u00ebrfshin t\u00eb drejt\u00ebn e vazhdim\u00ebsis\u00eb historike, t\u00eb drejt\u00ebn p\u00ebr vet\u00ebidentifikim dhe t\u00eb drejt\u00ebn p\u00ebr ruajtjen e elementeve kulturore t\u00eb komunitetit. Instrumentet nd\u00ebrkomb\u00ebtare si Deklarata e OKB-s\u00eb p\u00ebr t\u00eb Drejtat e Popujve Autokton\u00eb (UNDRIP) theksojn\u00eb t\u00eb drejt\u00ebn p\u00ebr ruajtjen e trash\u00ebgimis\u00eb kulturore dhe p\u00ebr t\u00eb mos u imponuar asimilim. [7] N\u00eb k\u00ebt\u00eb kontekst, trajtimi i shqiptar\u00ebve t\u00eb Dardanis\u00eb Lindore si \u201cminoritet\u201d \u00ebsht\u00eb nj\u00eb reduktim i statusit t\u00eb tyre historik dhe juridik. [8]<\/div>\n<\/div>\n<div class=\"x14z9mp xat24cr x1lziwak x1vvkbs xtlvy1s x126k92a\">\n<div dir=\"auto\">2.2. Simbolet kulturore si pjes\u00eb e t\u00eb drejt\u00ebs s\u00eb shprehjes<\/div>\n<div dir=\"auto\">Simbolet kulturore (monumente, lapidar\u00eb, memoriale, toponime) nuk jan\u00eb objekte neutrale; ato jan\u00eb \u201ctekstualizime\u201d t\u00eb historis\u00eb dhe identitetit kolektiv. Kur shteti i heq ato, ai nuk fshin vet\u00ebm nj\u00eb objekt, por edhe narrativ\u00ebn historike dhe identitetin e komunitetit. Kjo lidhet me konceptin e \u201cshprehjes simbolike\u201d si pjes\u00eb e t\u00eb drejt\u00ebs s\u00eb shprehjes (neni 10 i KEDNJ-s\u00eb) [9] dhe t\u00eb s\u00eb drejt\u00ebs p\u00ebr jet\u00eb private (neni 8 i KEDNJ-s\u00eb) [10] si aspekt i identitetit kulturor. [11]<\/div>\n<\/div>\n<div class=\"x14z9mp xat24cr x1lziwak x1vvkbs xtlvy1s x126k92a\">\n<div dir=\"auto\">2.3. Etnocidi kulturor<\/div>\n<div dir=\"auto\">Raphael Lemkin, n\u00eb pun\u00ebn e tij p\u00ebr konceptin e gjenocidit, p\u00ebrfshiu edhe shkat\u00ebrrimin e elementeve kulturore q\u00eb ruajn\u00eb identitetin e nj\u00eb populli. [12] Etnocidi kulturor, sipas doktrin\u00ebs bashk\u00ebkohore, p\u00ebrfshin asimilimin e detyruar, fshirjen e gjuh\u00ebs, d\u00ebbimin nga hap\u00ebsira publike dhe shkat\u00ebrrimin e simboleve kulturore. [13]<\/div>\n<div dir=\"auto\">Metodologjia<\/div>\n<div dir=\"auto\">Ky studim p\u00ebrdor metod\u00ebn e analiz\u00ebs s\u00eb dokumenteve (document analysis) dhe krahasimit juridik (comparative legal analysis). [14]<\/div>\n<div dir=\"auto\">Kontessti historik dhe politik i Dardanis\u00eb Lindore<\/div>\n<div dir=\"auto\">4.1. Vazhdueshm\u00ebria historike e shqiptar\u00ebve n\u00eb Dardani<\/div>\n<div dir=\"auto\">Dardania ka qen\u00eb nj\u00eb rajon me prani t\u00eb vazhdueshme shqiptare dhe me struktur\u00eb kulturore t\u00eb konsoliduar. Edhe pse kufijt\u00eb politik\u00eb kan\u00eb ndryshuar, popullsia ka ruajtur identitetin dhe lidhjen me hap\u00ebsir\u00ebn. Kjo e b\u00ebn trajtimin e shqiptar\u00ebve t\u00eb Dardanis\u00eb Lindore si \u201cminoritet\u201d nj\u00eb reduktim t\u00eb paarsyesh\u00ebm t\u00eb statusit t\u00eb tyre historik. Politikat shtet\u00ebrore pas vitit 1999<\/div>\n<\/div>\n<div class=\"x14z9mp xat24cr x1lziwak x1vvkbs xtlvy1s x126k92a\">\n<div dir=\"auto\">Pas p\u00ebrfundimit t\u00eb konfliktit n\u00eb Kosov\u00eb, Dardania Lindore u p\u00ebrball me rritje t\u00eb pranishm\u00ebris\u00eb s\u00eb forcave t\u00eb siguris\u00eb dhe me politikat e marginalizimit institucional. [16] N\u00eb k\u00ebt\u00eb kontekst, U\u00c7PMB-ja u formua si reagim ndaj situat\u00ebs s\u00eb siguris\u00eb dhe diskriminimit institucional. [17] Marr\u00ebveshja e Kon\u00e7ulit (2001) synoi integrimin dhe ruajtjen e identitetit, por tensionet mbet\u00ebn. Lapidari i U\u00c7PMB-s\u00eb si simbol i kujtes\u00ebs kolektive<\/div>\n<div dir=\"auto\">Lapidari n\u00eb qend\u00ebr t\u00eb Preshev\u00ebs ishte nj\u00eb memorial i r\u00ebn\u00ebve t\u00eb U\u00c7PMB-s\u00eb, dhe p\u00ebr komunitetin shqiptar p\u00ebrfaq\u00ebsonte nj\u00eb element t\u00eb r\u00ebnd\u00ebsish\u00ebm t\u00eb kujtes\u00ebs kolektive dhe identitetit t\u00eb tyre. Heqja e tij n\u00eb m\u00ebnyr\u00eb t\u00eb papritur dhe t\u00eb kontrolluar nga forcat e xhandarm\u00ebris\u00eb serbe tregon nj\u00eb nd\u00ebrhyrje t\u00eb q\u00ebllimshme n\u00eb hap\u00ebsir\u00ebn kulturore. [19]<\/div>\n<\/div>\n<div class=\"x14z9mp xat24cr x1lziwak x1vvkbs xtlvy1s x126k92a\">\n<div dir=\"auto\">Heqja e Lapidarit:P\u00ebrshkrimi i aktit dhe analiza e nd\u00ebrhyrjes<\/div>\n<div dir=\"auto\">5.1. Raportimet tregojn\u00eb se ishte nj\u00eb operacion i planifikuar, me masa t\u00eb forta sigurie, dhe me pjes\u00ebmarrjen e zyrtar\u00ebve t\u00eb lart\u00eb t\u00eb policis\u00eb dhe xhandarm\u00ebris\u00eb. P\u00ebrmasat simbolike dhe ndikimi n\u00eb komunitetin lokal<\/div>\n<div dir=\"auto\">Heqja e lapidarit nuk ishte nj\u00eb veprim teknik; ajo p\u00ebrb\u00ebn nj\u00eb akt simbolik q\u00eb synon fshirjen e kujtes\u00ebs kolektive. Polonia (Grand Chamber, 2004)<\/div>\n<div dir=\"auto\">N\u00eb k\u00ebt\u00eb rast, GJEDNJ theksoi r\u00ebnd\u00ebsin\u00eb e liris\u00eb s\u00eb shprehjes dhe pjes\u00ebmarrjes p\u00ebr komunitetet etnike, duke pranuar se organizatat q\u00eb mbrojn\u00eb identitetin kulturor dhe trash\u00ebgimin\u00eb luajn\u00eb rol ky\u00e7 n\u00eb shoq\u00ebrit\u00eb demokratike. Gjykata theksoi se liria e shprehjes p\u00ebrfshin edhe shprehjen simbolike dhe aktivitetet q\u00eb mbrojn\u00eb identitetin kulturor t\u00eb komuniteteve etnike. [31]<\/div>\n<div dir=\"auto\">7.2. Dimitras v. Greece (2001)<\/div>\n<\/div>\n<div class=\"x14z9mp xat24cr x1lziwak x1vvkbs xtlvy1s x126k92a\">\n<div dir=\"auto\">Ky rast vendos standardin p\u00ebr kufizimin e liris\u00eb s\u00eb shprehjes: \u00e7do kufizim duhet t\u00eb jet\u00eb i parashikuar n\u00eb ligj, t\u00eb ket\u00eb arsye legjitime, t\u00eb jet\u00eb i domosdosh\u00ebm dhe proporcional. [32] Kjo \u00ebsht\u00eb nj\u00eb baz\u00eb p\u00ebr t\u00eb vler\u00ebsuar heqjen e lapidarit si nd\u00ebrhyrje n\u00eb shprehjen simbolike t\u00eb komunitetit. Bulgaria (2021)<\/div>\n<div dir=\"auto\">N\u00eb k\u00ebt\u00eb rast, GJEDNJ trajtoi kufizimin e liris\u00eb s\u00eb shprehjes p\u00ebrmes veprimeve simbolike ndaj nj\u00eb statuje. Gjykata theksoi se nd\u00ebrhyrja shtet\u00ebrore duhet t\u00eb jet\u00eb e domosdoshme dhe proporcionale, dhe se nj\u00eb kufizim nuk mund t\u00eb justifikohet vet\u00ebm nga rregulli i rendit publik pa prova t\u00eb qarta. Romania (2019)<\/div>\n<div dir=\"auto\">K\u00ebto raste theksojn\u00eb se identiteti kulturor dhe i komunitetit \u00ebsht\u00eb pjes\u00eb e jet\u00ebs private, dhe se nd\u00ebrhyrjet e shtetit n\u00eb k\u00ebt\u00eb fush\u00eb duhet t\u00eb jen\u00eb t\u00eb kufizuara dhe t\u00eb bazuara n\u00eb nevoj\u00eb reale. [35] GJEDNJ ka pranuar se komuniteti ka interes legjitim p\u00ebr t\u00eb mbrojtur simbolet dhe hap\u00ebsirat e tij kulturore, dhe se shteti nuk mund t\u00eb imponoj\u00eb standarde uniformizuese n\u00eb m\u00ebnyr\u00eb arbitrare. Bosnje e Hercegovina: Monumenti i Srebrenic\u00ebs<\/div>\n<div dir=\"auto\">N\u00eb Bosnje, kontestet mbi memorialet e Srebrenic\u00ebs tregojn\u00eb se simbolet kulturore mund t\u00eb jen\u00eb objekt i p\u00ebrpjekjeve p\u00ebr t\u00eb riformuar narrativ\u00ebn historike.
